This Privacy Statement covers the use of all Actual Experience web sites at actual-experience.com, Perception Agents and the Analytics Engine.

The Actual Experience privacy statement has been created using best practice guidance from the OECD, the UK Information Commissioners Offices and a recommended Code of Fair Information Practice drafted by a US federal task force in 1973.

What does Actual Experience do?

Actual Experience is a spin-out from Queen Mary, University of London. We collect and analyse internet performance data in order to improve the individual human experience of internet applications.

Measuring your Internet performance

Internet performance is measured from your computer or phone using a small software program known as the ‘Perception Agent’. The Agent does not monitor what you do on your PC; instead it sends test messages to measure in-house, broadband access, local, national and global internet performance as seen by your PC. Measured performance data is transmitted to Actual Experience’s Analytics Engine, located in Bristol, UK. The Engine then analyses your data in order to provide information about your internet performance. The Analytics Engine also analyses data from all Agents in two further ways that also benefits you:
  1. To provide businesses that supply internet services (such as ISPs and content providers) with information on how to improve the human experience of their services;
  2. Provide Internet regulators with information about the human experience of national Internet infrastructure.

What personal information does Actual Experience collect?

The Agent on your PC asks for some personal information about you, which includes your name, email address and agent location. This information is only used to communicate with you and to provide geographical information about internet performance. The Agent also collects measurement data, which includes IP addresses, for in-house, broadband access, local, national and global internet performance as described above. When we provide information to businesses, your personal information (including personal IP addresses) described above is not included and all other data is strictly anonymous.
If you use our analytics website to view your internet performance, you will be requested to create an account with us by supplying your email address and a personal password.

Use of Cookies on your sites?

We only use cookies on our sites at actual-experience.com to store temporary information relating to your current session with the web server. We do not track via cookies any user behaviour in terms of websites visited and we do not transmit any personal information via cookies to our server.

What Security measures do we take to protect your data?

We use commercially reasonable business and technical practices to secure our Analytics Engine, and, although we cannot guarantee the security of data or information or be responsible for infiltration or hacking, we have implemented security policies, firewall software, rules and other technical measures to protect the personal data that we have under our control from:
  1. Unauthorised access;
  2. Improper use or disclosure;
  3. Unauthorised modification;
  4. Unlawful destruction or accidental loss.
All employees who have access to and are associated with the processing of personal data are obliged to respect the confidentiality of personal data.

Access or removal of your personal information

You may ask what data we hold about you or request that we remove any personal information we may hold at any time if you so request by emailing our Data Protection Officer

Where your personal data is held

Actual Experience currently hosts the service in Bristol, United Kingdom but reserves the right to replicate its database in locations outside of the European Economic Community (EEC) to improve performance for members not located in Europe. Actual Experience will use best industry practice to ensure that adequate safeguards are in place at the selected hosting centres to ensure a high degree of privacy.

Privacy compliance

Our privacy policy is compliant with the following instrument UK Data Protection Act. In order to demonstrate that our privacy policy accords with the above privacy instrument, we are voluntarily committed to a self-assessment procedure.

Dispute resolution

If you believe that Actual Experience has not adhered to this Privacy Statement, please contact our Data Protection Officer in the first instance and we will do our best to address your concerns. If you are not satisfied with our response to your privacy concern, in addition to any rights which you may have at law, we provide you with the option of using a third party dispute resolution service.

Changes to this Privacy Policy

Actual Experience may amend this Privacy Statement from time to time. If we make substantive change in the way we manage your personal data we will notify you by email using your preferred email address and prominently post the changes on the web site. Any change will become effective 30 calendar days from the day that the change was posted. Please note that you are responsible for keeping your preferred email address up to date. In the event that your last provided email address is not valid, our posting of the change on the Actual Experience website will nevertheless constitute valid notice of change.
